8 Limitations of liability
8.1 Dom Master K will not be liable to you (whether under the law of contact, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this website

- for any indirect, special or consequential loss; or
- for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.
8.2 These limitations of liability apply even if Dom Master K has been expressly advised of the potential loss.
8.3 Should legal proceedings be commenced against Dom Master K, we reserve the right to pause or discontinue the service provision to the client – at least until legal matters have concluded or are withdrawn. Dom Master K are under no obligation to continue providing a service to a client that has commenced legal proceedings – clients acknowledge this before conducting business with us, and these terms are retrospective..
Exceptions
Nothing in this website disclaimer will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit, and nothing in this website disclaimer will exclude or limit Dom Master K liability in respect of any:
- death or personal injury caused by Dom Master K negligence;
- fraud or fraudulent misrepresentation on the part of Dom Master K; or
- matter which it would be illegal or unlawful for Dom Master K to exclude or limit, or to attempt or purport to exclude or limit, its liability.
9 Reasonableness
9.1 By using this website, you agree that the exclusions and limitations of liability set out in this website disclaimer are reasonable. If you do not think they are reasonable, you must not use this website.
10 Refunds
Sending your deposit for a booking with DMK signifies the acknowledgement and acceptance of the following payment terms…
10.1 All deposits, especially paid booking fees, are non-refundable once paid. This is because your payment was locked on a specific date in my diary, and no one else was able to book because of your booking. If the booking is cancelled, the time missed cannot be taken back to offer the booking to anyone else.
10.2 I reserve the right to move/adjust the booking date in the case of a personal emergency, sickness, etc. In this case I will aim to give clear and concise communication of this with as much notice as possible.
10.3 A refund (full or partial) MAY only be offered if Dom Master K needs to cancel your entire booking for whatever reason. It is by no means guaranteed or assured. In this case, you are to allow up to 30 days (1 month) to receive your full refund.
10.4 Clients sending in their deposit are considered to be committed to paying the rest of the balance due on their booking in full. No refund is to be due if the balance of their booking has not been paid in FULL
11 Other parties
11.1 The client accepts that, as a limited liability entity, Dom Master K has an interest in limiting the personal liability of its officers and employees. The client agrees not to bring any claim personally against Dom Master K officers or employees in respect of any losses you suffer in connection with the website.
11.2 Without prejudice to the foregoing paragraph, you agree that the limitations of warranties and liability set out in this website disclaimer will protect Dom Master K officers, employees, agents, subsidiaries, successors, assigns and sub-contractors as well as Dom Master K.
12 Unenforceable provisions
12.1 If any provision of this website disclaimer is, or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of this website disclaimer.
13 Indemnity
13.1 The client hereby indemnifies Dom Master K and undertakes to keep Dom Master K indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by Dom Master K to a third party in settlement of a claim or dispute on the advice of Dom Master K legal advisers) incurred or suffered by Dom Master K arising out of any breach by you of any provision of these terms and conditions, or arising out of any claim that you have breached any provision of these terms and conditions.
14 Breaches of these terms and conditions
14.1 Without prejudice to Dom Master K other rights under these terms and conditions, if you breach these terms and conditions in any way, Dom Master K may take such action as Dom Master K deems appropriate to deal with the breach, including suspending your access to the website, halting your booking, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting thrid parties to request that they block your access to the website and/or bringing court proceedings against you.
- Rudeness, aggression and/or and offensive behaviour
15.1 Dom Master K staff have a right to conduct their daily business duties without fear of threat from rude or aggressive customers at any time while conducting business.
15.2 The client agrees that Dom Master K reserves the right to halt or even terminate the clients’ bookings if there is ANY element of rude, threatening or aggressive behaviour towards Dom Master K staff via ANY means of communication with us. This includes but is not limited to threats of legal action against Dom Master K.
16 Variation
16.1 Dom Master K may revise these terms and conditions from time to time. Revised terms and conditions will apply to the use of this website from the date of the publication of the revised terms and conditions on this website. Please check this page regularly to ensure you are familiar with the current version.
17 Assignment
17.1 Dom Master K may transfer, sub-contract or otherwise deal with Dom Master K rights and/or obligations under these terms and conditions without notifying you or obtaining your consent.
17.2 You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions without first notifying Dom Master K.
18 Severability
18.1 If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.
19 Entire agreement
19.1 These terms and conditions constitute the entire agreement between you and Dom Master K in relation to your use of this website, and supersede all previous agreements in respect of your use of this website.
20 Law and jurisdiction
These terms and conditions will be governed by and construed in accordance with GOVERNING LAW, and any disputes relating to these terms and conditions will be subject to the Dom Master K owners’ local law.
